Terms of Service

Effective July 30, 2026

These Terms of Service ("Terms") govern your use of Traveling Portrait ("Traveling Portrait," "we," "us") — our portfolio platform, print fulfillment tools, and related features (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What the Service is

Traveling Portrait lets photographers ("Photographers," "you") build a portfolio website, sell prints through our fulfillment partner WHCC, connect a custom domain, run private client proofing galleries, and collect booking inquiries — all from one dashboard. Some features are limited to specific subscription plans, as described on our pricing page.

2. Accounts

You must be at least 18 years old to create an account. We use passwordless "magic link" login sent to your email — you're responsible for keeping access to that email address secure, since anyone who can read it can log in as you. You're responsible for all activity under your account, and for keeping your account and site information accurate.

3. Subscriptions and billing

Paid plans include a 14-day free trial. A valid payment card is required to start the trial, but you won't be charged until it ends. After the trial, your card is billed automatically on a recurring basis until you cancel. You can upgrade, downgrade, or cancel your subscription at any time from your dashboard — cancellation stops future billing but doesn't refund amounts already charged. Billing is processed by Stripe; we don't store your full card details.

4. Your content

You retain ownership of every photo, and all other content, you upload to your site. By uploading content, you grant us a license to host, store, display, and process it solely to operate and provide the Service — including generating the previews WHCC uses to produce prints. You're responsible for having the rights to everything you upload, and for not uploading content that infringes someone else's rights or violates the law.

5. Print orders

When a visitor orders a print through your site, the order is placed directly with WHCC, a third-party photo lab, for production and shipping. We facilitate that order but WHCC is responsible for print quality, production, and delivery. Pricing shown at checkout is set by WHCC's catalog; we don't add a markup on top of it. Issues with a specific print order — damage, print quality, shipping delays — should be raised with us so we can work with WHCC on a resolution, but we can't guarantee a specific outcome for third-party fulfillment issues.

6. Client data you collect

Features like proofing galleries and the booking inquiry form let your visitors and clients share information with you — names, emails, phone numbers, event dates, and photo selections. You control that data and are responsible for how you use it and for complying with any laws that apply to your own business and clients. We process it on your behalf only to operate these features, as described in our Privacy Policy.

7. Custom domains

Pro and Studio plans can connect a domain you own. You're responsible for owning or controlling that domain and for configuring the DNS records we provide. We handle SSL certificate provisioning for connected domains automatically, but we don't manage domain registration or renewal — that stays with your registrar.

8. Acceptable use

You agree not to use the Service to:

  • Upload or sell content you don't have the rights to
  • Host illegal content, or content that infringes someone else's intellectual property
  • Send spam, phishing attempts, or malicious code through any part of the Service
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service
  • Use the contact or inquiry forms to harass or abuse other users or their visitors

9. Termination

You can cancel your subscription and delete your account at any time from your dashboard, which permanently removes your site, photos, and account data. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that creates risk or legal exposure for us or other users. Where practical, we'll try to notify you first.

10. Disclaimers

The Service is provided "as is." We work to keep it available and reliable, but we don't guarantee it will be uninterrupted, error-free, or available at all times. We aren't responsible for outages or errors caused by third-party services we depend on — including Stripe, WHCC, Cloudflare, and our hosting provider.

11. Limitation of liability

To the fullest extent permitted by law, Traveling Portrait's total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months before the claim. We aren't liable for indirect, incidental, or consequential damages, including lost profits or lost data.

12. Indemnification

You agree to indemnify and hold us harmless from any claim arising from content you upload, your use of the Service, or your violation of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify you by email.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.
